Adnan Ahmadzade's lawyer - head of ministry department? - Photo


Adnan Ahmadzade's lawyer, Shaig Mirzoyev, is reportedly the head of the legal, human resources, and documentation department of the public institution "National Observatory on Labor Market and Social Protection Issues" under the Ministry of Labor and Social Protection of the Republic of Azerbaijan.
According to Yeniavaz.com, renowned lawyer Akram Hasanov published this information on his social media account.
Akram Hasanov stated that, according to Article 9.3.1 of the Law "On Combating Corruption," holding other paid positions or engaging in other activities, with the exception of scientific, pedagogical, and creative work, while on official duties is considered an offense that creates conditions for corruption:
"The problem isn't that Mirzoyev is a lawyer. He can be a lawyer. But he cannot provide services to anyone other than his employer on a paid basis. Mirzoyev himself stated yesterday that he is defending Akhmedzade. That is, for a fee. This can be considered an offense that creates conditions for corruption. I sent a letter to the Prosecutor General's Office, the Ministry of Internal Affairs, the State Security Service, and the Minister of Labor and Social Protection of the Population asking them to assess the situation and take action.
There is another side to the issue. According to paragraph 7 of the "Rules of Ethical Conduct for Employees Who Are Not Civil Servants Employed in the System of the Ministry of Labor and Social Protection of the Population of the Republic of Azerbaijan," employees, with the exception of scientific and creative activities, cannot engage in teaching without the permission of the head of the institution where they work. Employees must also refrain from outside activities that negatively impact their work performance and ability to work. Therefore, this rule has also been violated. Finally, from a common sense perspective, how can someone who practices law not only in Baku but also in the regions at least several times a week be the head of the legal, personnel, and documentation department at the public legal entity "National Observatory on Labor Market and Social Protection"? Is he breaking the law when he should be upholding it? When should he be monitoring staff timekeeping while not at work? After all, he receives a salary from the state, meaning at our expense. Why?"

Fidan Seidshahgizi, press secretary for the National Observatory on Labor Market and Social Protection, stated that Shaig Mirzoyev is not currently an employee of the organization:
"His employment contract has been terminated."
However, she did not specify when exactly the contract was terminated. A. Hasanov, in turn, stated that when he posted this information on his social media account, Shaig Mirzoyev was listed in this position on the organization's official website.
