EP buys a BMW 520i from the former minister for 133 thousand - 17.5 thousand more than the market price

The executive power of the city of Sumgayit entered into a purchase and sale agreement with İmprotex Motors LLC (TIN – 1400064731), headed by former Minister of Labor and Social Protection of the Population Fizuli Alekperov.
Yeniavaz.com reports that the executive power of the city of Sumgayit will buy a BMW 520i passenger car from LLC İmprotex Motors for 133 thousand manats.
For information, the BMW 520i passenger car, manufactured in 2023 and with a mileage of only 24 km, is currently being sold for 115,600 manats on the country’s leading classifieds websites.
It should be noted that this contract was concluded using the single-source procurement method and the procurement procedure was not carried out on a single Internet portal for public procurement. For this reason, the reason why the car purchased by the Sumgayit city executive authority from the former minister costs 17.4 thousand manats more than the market price is unknown.
It should be noted that Article 15.1 of the Law “On Public Procurement” states that all public procurement, with the exception of confidential information, is carried out only through the portal.
At the same time, Article 49 of the Law states that the single-source procurement method is applied in the following cases:
- When the item being purchased is only available from a specific supplier;
- If there is no substitute or alternative to the item purchased;
- If there is an urgent demand for the item to be purchased;
- In case of natural disasters, man-made accidents, epidemics and other emergency situations in order to immediately prevent harm to human life and health;
- When the item being purchased is related to the demand for intelligence and counterintelligence activities.
As can be seen from the requirements of the law, the purchase of a BMW 520i car by the executive branch cannot be considered confidential information. The reason for conducting the procurement process in this manner is unclear. However, it is unclear why the contract was awarded using the single-source procurement method.
