Another mysterious tender in the ministry - Where are the millions of funds going?

The Ministry of Labor and Social Protection of the Population entered into a purchase and sale agreement with Excellent Trade JSC (TIN – 2906487651).
Yeniavaz.com reports that according to the contract signed on the basis of the single-source procurement method, Excellent Trade CJSC will organize intergovernmental meetings commissioned by the Ministry of Labor and Social Protection of the Population and will receive 28,652 manats and 70 kopecks in return.
For your information, we inform you that the procurement procedure under this agreement was not carried out on the unified Internet portal of government procurement.
Article 15.1 of the Law “On Public Procurement” states that all public procurement, with the exception of confidential information, is carried out only through the portal.
Moreover, Article 49 of the Law states that the single-source procurement method is applied in the following cases:
- When the item of purchase is only available from a specific supplier;
- If there is no substitute or alternative to the item purchased;
- If there is an urgent demand for the item to be purchased;
- In case of natural disasters, man-made accidents, epidemics and other emergency situations in order to immediately prevent harm to human life and health;
- When the item being purchased is related to the demand for intelligence and counterintelligence activities.
As can be seen from the requirements of the law, intergovernmental meetings cannot be considered confidential information. For this reason, it is incomprehensible that the Ministry of Labor and Social Protection of the Population conducts the procurement process in this way. Moreover, it is unclear why the contract was awarded under the sole source procurement method.
It should be noted that “Excellent Trade” CJSC, with which the ministry entered into a purchase and sale agreement, on November 17, 2021, is registered in the city of Sumgayit, d. 5, building 11/18, m 7. The legal representative of Excellent Trade LLC, whose authorized capital is 10 manats, is Vusal Shahbaz oglu Hasanov. Later, the “Excellent Trade” organization changed its organizational and legal form and became a joint-stock company, increased its authorized capital to 2010 manats and Aleskarov Kamal Aleskar oglu became the legal representative.
It should also be noted that CJSC “Excellent Trade” began to win tender competitions of the Ministry of Labor and Social Protection of the Population soon after its registration.
The joint-stock company, which does not even have an official website, won tenders worth millions of manats conducted by the ministry.
