“Əsaslı Tikinti və Təchizat” LLC, operating under the Ministry of Culture, signed a purchase and sale agreement with “Azərmətbuatyayımı” OJSC (TIN-1500515761).
Yeniavaz.com reports that the Ministry of Culture signed this contract without holding a tender, using the procurement method from a single source.
According to the terms of the contract, Azərmətbuatyayımı OJSC will provide the Ministry of Culture with the service of “subscribing to official newspapers, as well as a number of independent press agencies promoting national and state traditions, to receive information about the multifaceted and continuous reforms being implemented in our country, the development of all areas our life”, and in return will receive 15 thousand 166 manats 80 kopecks.
One of the features of the tender is that the procurement procedure for this contract was not carried out on a single Internet portal of government procurement.
For information, Article 15.1 of the Law “On Public Procurement” states that all public procurement, with the exception of confidential information, is carried out only through the portal.
Another point is to conduct procurement using the single source procurement method.
As you know, Article 49 of the Law “On Public Procurement” clearly states that the single-source procurement method is applied in the following cases:
- When the item of purchase is only available from a specific supplier;
- If there is no substitute or alternative to the item purchased;
- If there is an urgent demand for the item to be purchased;
- In case of natural disasters, man-made accidents, epidemics and other emergency situations in order to immediately prevent harm to human life and health;
- When the item being purchased is related to the demand for intelligence and counterintelligence activities.
It should be noted that it is unclear which of the conditions specified in the Law corresponds to a subscription to the official newspaper and other press agencies.
It should also be noted that OJSC “Azərmətbuatyayımı”, with which the Ministry of Culture entered into a purchase and sale agreement, was registered on August 7, 2007. The legal address of the OJSC, whose legal representative is Salmanov Suleyman Ali, is located at the address: Narimanov district, Jeyhun Hajibeyli, building 30 K.
Let us note that the founder of OJSC “Azərmətbuatyayımı” is LLC “Kaspi Mətbuat Yayım” (TIN – 1700165031). The legal representative of Kaspi Mətbuat Yayım LLC, registered on March 1, 2004, is Salmanov Suleyman Ali ogly.
At the state registered legal address of Kaspi Mətbuat Yayım LLC - Fikret Amirov Street, Building 1, there are companies associated with members of the family of Ali Hasanov, the former head of the department of socio-political issues of the presidential administration.
Ali Hasanov’s son Shamkhal Hasanly, living in the USA, headed ATOM QIDA LLC (TIN -1701554201), registered and liquidated at 1 Fikret Amirov Street.
In 2021, “Baku 24” LLC, “Kaspi AZ” LLC, “Mətbuat evi” LLC, “Golden Prince” LLC, “Global Advertisment” LLC and MTK “Kaspi Co” located at Fikret Amirov Street, building 1 and owned by members Ali Hasanov's family also announced their liquidation. These companies were headed by Azer Veliyev, a close relative of Shamkhal Hasanli and Ali Hasanov’s wife Sona Veliyeva.
In addition, Ali Hasanov’s wife Sona Valieva is also the legal representative of Kaspi Education LLC (TIN - 1701352711), registered at Fikret Amirova Street, building 1.
