LLC "Nord Star Pharma" (TIN 1703065921) was declared the winner of the tender held by the Agrarian Services Agency under the Ministry of Agriculture.
Yeniavaz.com reports with reference to published official information, that the Agricultural Services Agency held a tender (Open Competition) in October this year to purchase reactives, reagents and disinfectants for the Laboratory, the Center for Expertise and Certification.
The announcement of the tender notes that when assessing, 20 points will be given for the delivery time of goods, and 80 points for the price offer for 169 goods.
When opening the tender proposals (envelopes of proposals) submitted for the competition, it became known that price proposals were sent by 5 companies. Although the terms of the tender announcement stated that 80 points would be awarded to the bid, the lowest bidder did not win at the end of the competition.
For information, we note that the price offer of "Nord Star Pharma" LLC, which was announced as the winner, was 360,753.25 manats. However, LLC "Baba Lab" (TIN - 4002460141) submitted the lowest price offer in the tender. "Baba Lab" LLC offered 261,574.35 manats for 169 items, which is approximately 100,000 manats less than "Nord Star Pharma" LLC.
Interestingly, the Agricultural Services Agency decided to buy products offered at a higher price, rejecting the company that offers products at a lower price.
On this occasion, the Ministry of Agriculture told Yeniavaz.com that during the evaluation of the tender proposal submitted by "Baba Lab" LLC, it was determined that the tender proposal was 52% lower than the expected amount. For this reason, in accordance with Article 27.4 of the Law of the Republic of Azerbaijan "On Public Procurement", given that the price of the offer submitted by the consignor (applicant) is 20 percent lower than the probable price, in accordance with the requirement of Article 27.4.1 of the Law, in order to obtain information about the characteristics of the goods through the Internet, the request was addressed to the applicant. When analyzing the certificates submitted in response to the request, it was found that 16 items of goods were expired.
Due to the expiration of the certificates of analysis issued for the offered goods, the plaintiff was excluded from the assessment in accordance with Article 36.5.3 of the Law of the Republic of Azerbaijan "On Public Procurement".
"Baba Lab" LLC told Yeniavaz.com that the tender committee asked them for information about the composition and properties of the product:
"It is clear that after winning the tender, we will present new manufactured products. For this reason, we cannot submit to the tender commission an analysis report for a product that has not yet been produced. In order for the tender commission to receive information about the composition and properties of the product, we submitted analysis reports for this the same product with the old date and informed the commission in advance so that they are taken into account. That is, the certificate of analysis that we provide does not mean that we will provide that product. This certificate is provided only for the purpose of providing information about the composition and properties of the product. However, members The commissions did not take this into account and did not give us any information about it."
It should also be noted that "Baba Lab" LLC was registered in the state on 04/21/2020. LLC, the legal representative of which is Babazade Murad Maharram oglu, has previously won numerous tenders in similar areas in state institutions. Last month, the company won a 94,000 manat tender held by the Food Safety Institute.
LLC "Nord Star Pharma" was registered on 05/31/2021. There is no official information that the company, whose legal representative is Hajiyeva Ramila Avtandil gizi, has previously won tenders.
